Welcome to SafeCircle. These terms and conditions (“Terms”) govern your use of SafeCircle’s services (“Service”) via our website (“Website”) (referred to as the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please refrain from using the Service.

Definitions

• Company: "Safecircle," "safecircle.co.in," "Company," "we," "our," "us," or "Service Provider" refers to Safecircle Technologies (OPC) Pvt. Ltd., the entity providing the Services outlined in this document.

• User: "Client," "user," "you," or similar terms refer to you, the individual accessing and using our website, mobile application(s), and Services.

• Platform: "Platform" denotes any mobile app, website, or web links through which you access our Services.

• Professional: "Professional," "Counselor," "Consultant," or similar terms refer to the mental health and wellness practitioners associated with Safecircle.

By accessing or using the Service, you agree to comply with and be bound by these Terms, along with our Privacy Policy and any other policies or disclaimers posted on the Platform (collectively, “Related Agreements”). If you do not accept all the Terms, or if you are under 18 years of age, please do not use the Service. Ensure you review all the Terms carefully before proceeding.

Terms of Use

By choosing to visit and/or avail of any Services and/or product and/or resource from SafeCircle, the user confirms that they are above 18 years of age and are not otherwise incompetent to contract under the applicable laws and are legally allowed to make their own decisions. The user also accepts and agrees to our Terms and Conditions.

We reserve the right to add, modify or remove sections from the Terms and Conditions at any point in time during the course of the agreement with no prior notice. Continuing to use the SafeCircle platform, or purchasing any Service, resource, or product forms an obligatory legal agreement between the user and SafeCircle. Liability to review the User Agreement from time to time lies with the user. Continuation of the use of the platform after revision of the User Agreement will be deemed to be an acceptance of the revised terms.

User Representations

By using the Service, you (i) agree to these Terms, and (ii) confirm that you are over 18 years old and legally capable of forming binding contracts.

Dispute Resolution

​

Should any disputes arise between you and SafeCircle that cannot be resolved, the matter will be addressed through a specific dispute resolution process, which may include arbitration. Arbitration is binding, more informal than a lawsuit, and uses a neutral arbitrator instead of a judge or jury. You also agree that any claims or disputes will not be brought as class actions. Please read the Dispute Resolution section carefully.

License to Use the Platform

Unless otherwise stated, SafeCircle and/or its licensors own the intellectual property rights on the Platform and the materials on it. SafeCircle grants you a non-exclusive, non-transferable subscription to use the Service during the Term, solely for your personal/internal use, subject to these Terms.

All content on the Platform is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You may not use, modify, copy, reproduce, republish, upload, post, transmit, or distribute any content from the Service for commercial purposes without the permission of the copyright owner.

Content and User Responsibility

All content posted or otherwise made available via the Service is the sole responsibility of the person who originated it. SafeCircle does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted via the Service. You may be exposed to content that might be offensive, harmful, inaccurate, or otherwise inappropriate. SafeCircle is not liable for such content.

Reporting Inappropriate Content

SafeCircle reserves the right to remove any content that violates these Terms, including but not limited to intellectual property violations, impersonation, unlawful conduct, or harassment. Users may report any inappropriate content by emailing us at support@safecircle.app.

User Conduct

You are solely responsible for your actions and conduct while using the Platform. SafeCircle is not liable for any consequences arising from your actions. You agree to indemnify and hold SafeCircle harmless against any loss, liability, or consequences arising from your actions.

Account Setup

You must provide accurate and complete information, including your full legal name, a valid email address, and any other information requested during the account setup process. You are responsible for maintaining the security of your account and password and for any activities that occur under your account. Notify SafeCircle immediately of any unauthorized use of your account.

Teleconsultation Services

​

SafeCircle facilitates connections with healthcare professionals through various online modes. While we collect your information to provide these services, SafeCircle does not provide healthcare services directly and is not responsible for any interactions between you and the healthcare professionals.

Booking and Payment

​

Bookings for healthcare services available on SafeCircle can be made through our Platform, which may include third-party links and generally accepted payment mechanisms. SafeCircle is not liable for any payment issues, but we will assist you in case of any difficulty.

Acceptable Use

​

You must not utilize the Platform in any manner that could damage it or compromise its availability or functionality. The Platform must not be used for any illegal, fraudulent, or harmful activities.

Indemnity

​

You agree to indemnify and protect SafeCircle from any losses, damages, expenses, liabilities, and costs arising from any breach by you of these Terms.

Dispute Resolution

​

Any disputes arising from the use of the Service will be resolved through arbitration. SafeCircle will appoint a sole arbitrator, and arbitration will occur in Noida, Uttar Pradesh. The courts in Noida, Uttar Pradesh will have exclusive jurisdiction over such disputes.

Limitation of Liability

​

SafeCircle provides its services and related documentation "as is," without any express or implied warranties. SafeCircle is not liable for any direct, indirect, special, or consequential damages arising from the use of the Platform.

Severability

​

If any provision of these Terms is deemed unenforceable under applicable law, the remaining provisions will continue in effect.

Variation of Terms

​

SafeCircle reserves the right to amend these Terms at any time. The revised Terms will be effective from the date they are published on the Platform. Please review this page regularly to stay informed of any changes.

Termination

​

You are responsible for properly closing your account, which can be done at any time by emailing us at contactsafecircle@gmail.com.

Assignment

​

SafeCircle may transfer its rights and obligations under these Terms without notifying you. You are not permitted to transfer your rights and obligations under these Terms.

Breaches of These Terms

​

If you violate these Terms, SafeCircle may take appropriate action, including suspending your access to the Platform, prohibiting you from accessing the Platform, blocking your IP address, contacting your ISP, and/or initiating legal proceedings against you.

Restricted Access

​

Access to certain areas of the Platform may be restricted. SafeCircle reserves the right to impose such restrictions at its discretion. If you are provided with a user ID and password, you must keep them confidential. SafeCircle may disable your user ID and password at any time without prior notice.

Entire Agreement

​

These Terms constitute the entire agreement between you and SafeCircle regarding your use of the Platform, superseding all previous agreements.
